EL PASO COUNTY - A tale of last words is revealed in an affidavit of probable cause in the shooting death of Victor San Miguel, who died late Thursday night from a gunshot.
28-year-old Denise Presson faces charges of first degree murder, menacing with a deadly weapon, and possession of weapons by previous offenders. Presson is accused of shooting and killing her sister's boyfriend, Victor San Miguel.
San Miguel died from a shot to the chest, after failed attempts to revive him.
In the affidavit, Presson told investigators why she allegedly pulled the trigger.
"I'm sorry I have to do this," Presson told San Miguel moments before she shot, according to the affidavit.
The report details how, when Presson arrived at the house in the 1800 block of Piute Road, she started talking with her 12-year-old nephew. Presson showed him a gun, asking if he wanted her to, "Take care of Victor."
Minutes later, San Miguel was shot with a .22 handgun.
In an interview later with police, Presson told investigators she thought San Miguel was abusing her nephew because she could "see it in his eyes."
The 12-year-old told investigators he never said that.
And the last words the boy heard from San Miguel?
"I love you."
Presson is no stranger when it comes to run-ins with the law. She is a convicted felon, having spent time in the Colorado Department of Corrections for pleading guilty to robbery in 1998. Just this year she was accused of misdemeanor child abuse and cruelty to animals.
Presson is now being held at the El Paso County Criminal Justice Center without bond.
