Jail time waived for mother of toddler shot in Colorado Springs

COLORADO SPRINGS - A judge waived jail time for a mother in Colorado Springs on Monday who was arrested on felony child abuse charges back in June of 2017. 

Monica Abeyta's toddler was shot by her 3-year-old son on June 3, 2017. According to arrest papers, Abeyta was upstairs in the bathroom when the shooting happened and that the gun used was later found wedged between the cushions of a chair in the living room. Abeyta told investigators that she normally kept the gun locked up but had gotten it out the night before because she was scared.

On Monday, Abeyta pleaded guilty to child abuse resulting in bodily injury in exchange for a deferred sentencing. 

The El Paso County judge waived jail time and released her bond. She was placed on four years of probation.
