Colorado Springs man indicted on second degree murder charge for downtown shooting

COLORADO SPRINGS, Colo. - An El Paso County Grand Jury has returned an indictment in a deadly January shooting that was investigated as a possible "make my day" case.

Patrick Thomas Rau, 28, was indicted on a charge of 2nd-degree murder in the heat of passion. The charges stem from the shooting death of Donald Russell, 37, in the early morning hours of January 19, 2017.

On the morning of the shooting, Rau told police that Russell went into the apartment building and confronted him, which led to the shooting.

In the days after the shooting, KRDO NewsChannel 13 reported that Russell was believed to be homeless.
 
After reviewing the evidence in the case, the grand jury found that Rau should be charged.
