Double murder suspect will be tried as an adult
A Colorado Springs judge has ruled that a double murder suspect who was 17 at the time of the killings will be tried as an adult.
Macyo January is accused of killing Staff Sergeant David Dunlap and his pregnant wife Whitney on January 14, 2013.
Prosecutors say January shot and killed the Dunlaps when they walked in on him while he was burglarizing their house on Bassett Drive.
On Wednesday, the courts ruled that there was enough evidence for this case to go to trial.
If convicted, January faces up to 40 years in prison.
When considering whether to reverse transfer the case to juvenile court the judge mentioned that had January been a few months older he could have been facing the death penalty because of the severity of the crime.
Defense lawyers for January argued that he would benefit from the youth offender system because treatment that he had received after previous crimes seemed to work.
The judge ultimately decided that January did not deserve the benefit of the doubt.
"His crimes became more bold, more dangerous, more brazen," said Judge Deborah Grohs. "He's in no better position to benefit from treatment."
