(CNN) -

Josh Brolin's list of New Year's resolutions might include avoiding any more arrests.

The 44-year-old actor was picked up by Santa Monica, California, police just before midnight on January 1 and booked on a misdemeanor charge of public intoxication around 3 a.m. the next day, according to the Los Angeles County Sheriff's Department.

He was released at about 7:15 a.m.

Brolin's rep declined to comment.

TMZ notes that since Brolin wasn't given a citation, he can wash his hands of the incident rather than having to go to court.

Funnily enough, the actor plays a Los Angeles-based police officer in his latest project, "Gangster Squad," which opens in theaters Friday.
