Double murder suspect Macyo January will be tried as an adult. January was a minor at the time of the murders, but a judge ruled Thursday he will be tried in adult court.
January is accused of killing a Fort Carson couple during a burglary. Family members of the couple spoke to Newschannel 13 (9/26/13) saying that is beginning of the justice they need.
"We are obviously very pleased with the rulings of the court,” said Kevin Butler, Whitney Butler’s father.
He was pleased, but not as happy as he would be if he were a new grandfather. Kevin's daughter Whitney and new husband Dave Dunlap's lives were cut short.
"It would never be easy to talk about your children and grandchildren who have been deceased,” said Kevin Butler.
They had only spent a few months in their new home and Whitney was expecting their first child. Then, on January 14 investigators say the couple came home and surprised a burglar in broad daylight. Both were shot and killed.
"The violent crimes and homicide unit were so effective in catching the accused and taking him off the streets," said Butler.
Police arrested Macyo January four days after the murders. He was 17 at the time, but a judge ruled on Thursday leniency is out of the question. January will be tried as an adult.
"If our statements today aided in the judge's ruling, then we're very pleased to make them,” said Butler.
Although it's a painful time for the families of a couple who should be celebrating a new grandchild, Butler said it brings some closure to them.
Newschannel 13 talked with the woman who January is accused of assaulting in her own home during another burglary. She said the judge's decision is the best news she's heard in a long time.
January is set to be arraigned November 21. That's when a trial will be scheduled.
