UPDATE: Man shot by CSPD identified

EPSO: Man shot by Springs police opened fire first

COLORADO SPRINGS, Colo. - The El Paso County Sheriff's Office says a man who was shot by Colorado Springs police officers Thursday night opened fire first. 

He has been identified as 39-year-old Shawn Michael Oliver. 

Deputies say Oliver had two felony warrants out of Adams County, and was acting suspiciously when Colorado Springs officers approached him Thursday night. 

The shooting happened at 9:13 p.m. outside of the Arby's restaurant in the 600 block of W. Garden of the Gods Road. 

The sheriff's office says the officers were contacting the man because he was behaving suspiciously. That's when the man reportedly took a shot at officers, prompting them to return fire. 

The man was taken to the hospital for treatment. The severity of his injuries is unknown.

No officers were hurt in the gunfire exchange.

State law requires an outside agency to investigate whenever a law enforcement officer is involved in a shooting.
